Agreement

Welcome to Willow Peptides. By accessing this website at www.willowpeptides.com (the "Website") or purchasing products from us, you agree to be bound by these Terms of Service (the "Terms"). If you do not agree to them, do not use the Website or place an order.

1. Acceptance of terms

By accessing or using the Website you confirm that you are at least 21 years old and have the legal capacity to enter into these Terms. If you use the Website on behalf of an organisation, you represent that you have the authority to bind that organisation.

2. Eligibility

Products are supplied only to qualified researchers, laboratory professionals and organisations engaged in legitimate scientific research. Willow Peptides may approve or decline any customer or order at its sole discretion, and may ask for verification of research credentials or institutional affiliation at any time. An order for which satisfactory verification is not provided may be cancelled.

3. Products and intended use

Every product sold by Willow Peptides is intended for laboratory research only. No product or statement on the Website has been evaluated by the U.S. Food and Drug Administration. By purchasing, you acknowledge and agree to each of the following.

Research only

Products are sold strictly for in vitro research and laboratory use.

Not for people or animals

Products are not for human or animal consumption, and not for diagnostic or therapeutic use.

No disease claims

Products are not intended to diagnose, treat, cure or prevent any disease.

No medical advice

Nothing on the Website is medical advice, dosing guidance, or a recommendation for human or animal use.

Compliance

You will comply with every local, state and federal law and regulation that applies to the purchase, possession and use of research chemicals.

Your status

You are a qualified researcher, or are purchasing for legitimate research purposes.

4. No customer accounts

The Website does not offer customer accounts. Orders are placed as a guest, and each order is reachable through the link in its confirmation email. Keep that email: anyone holding the link can view the order it belongs to.

5. Orders and payment

Orders are paid in Bitcoin. Placing an order creates the order and opens an invoice showing a Bitcoin address, a QR code and the exact amount due. No card details are collected and no money is taken by placing the order; payment happens when you send bitcoin to the invoice address.

Prices

You agree to pay the prices in effect when the order is placed. Prices are quoted in U.S. dollars and may change without notice.

Exchange rate

The bitcoin amount is fixed at the current exchange rate for 180 minutes. If the invoice expires unpaid, the order is not paid and a fresh order produces a fresh invoice at the current rate.

Confirmation

An order counts as paid when the payment has received one confirmation on the Bitcoin network. The Website and your confirmation email say when that has happened.

Underpayment

Bitcoin sent short of the invoice amount, or after the invoice has expired, is not matched automatically. Contact support with the order number and we will reconcile it by hand.

Finality

Bitcoin transactions cannot be reversed. Check the address and amount before sending. Bitcoin sent to an address that is not the invoice address cannot be recovered by us.

Acceptance

All orders are subject to acceptance and availability. Willow Peptides may refuse or cancel any order for any reason; a cancelled order that has been paid is refunded in bitcoin to an address you nominate.

6. Shipping and delivery

We ship to addresses within the United States. Shipping times are estimates and are not guaranteed. Risk of loss and title pass to you on delivery to the carrier, subject to the shipment protection described in Section 7. We are not responsible for delays caused by carriers or by circumstances beyond our control.

7. Replacements and refunds

Our returns page sets out the detail. In summary: a sealed vial that arrives damaged, is the wrong item, or does not match its certificate is replaced at no cost, without a return shipment, provided you contact support with photographs of the outer carton and the vial within 14 days of delivery. A parcel that is lost or stolen in transit is replaced under the shipment protection included with every order.

Once a vial's seal is broken it cannot be returned or replaced. We do not offer refunds for change of mind, dissatisfaction with research results, or misuse. Willow Peptides is not responsible for storage, handling or reconstitution after delivery.

8. Intellectual property

All content on the Website, including text, graphics, logos, illustrations and software, belongs to Willow Peptides or its licensors and is protected by intellectual property law. You may not reproduce, distribute, modify or create derivative works from it without our written permission. Published test reports remain the work of the laboratory that issued them and are reproduced with their verification keys intact.

9. Prohibited conduct

You agree not to do any of the following.

Unlawful use

Use the Website for any unlawful purpose.

Misrepresentation

Misrepresent your identity, affiliation or research status.

Interference

Interfere with or disrupt the Website or its servers, or attempt to gain unauthorised access to any part of it.

Scraping

Use automated means to access or scrape the Website.

Resale

Resell products without our written authorisation.

Misuse

Use products in a manner inconsistent with their intended research use.

Dosing

Discuss, promote or engage in any practice of human or animal dosing of products purchased from Willow Peptides, whether on the Website, in communications with us, or anywhere else.

Misrepresenting products

Market, label or represent any product purchased from Willow Peptides as suitable for human consumption, therapeutic use or veterinary application.

10. Refusal of service

Willow Peptides may refuse any current or future order at any time, for any reason, at its sole discretion, including for a breach of these Terms, suspected misuse of products, failure to provide research credentials when asked, or conduct we judge harmful to our business, other customers or the integrity of our operations. Refusal of service does not relieve you of obligations already incurred under these Terms, including indemnification.

11. Assumption of risk

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT YOUR PURCHASE, POSSESSION, HANDLING, STORAGE AND USE OF ANY PRODUCT FROM WILLOW PEPTIDES IS AT YOUR SOLE AND EXCLUSIVE RISK. WILLOW PEPTIDES SELLS RESEARCH CHEMICALS INTENDED SOLELY FOR IN VITRO LABORATORY USE. BY PURCHASING ANY PRODUCT YOU VOLUNTARILY ASSUME ALL RISKS ASSOCIATED WITH IT, INCLUDING RISKS ARISING FROM IMPROPER STORAGE, HANDLING, CONTAMINATION, DEGRADATION, MISUSE, OR ANY APPLICATION OF THE PRODUCT TO ANY HUMAN OR ANIMAL. TO THE FULLEST EXTENT PERMITTED BY LAW YOU WAIVE ALL CLAIMS AGAINST WILLOW PEPTIDES ARISING FROM YOUR USE OR MISUSE OF PRODUCTS.

12. Disclaimer of warranties

THE WEBSITE AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WILLOW PEPTIDES DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WITHOUT LIMITING THE FOREGOING, WILLOW PEPTIDES MAKES NO WARRANTY THAT (A) PRODUCTS WILL MEET YOUR RESEARCH REQUIREMENTS OR PRODUCE ANY PARTICULAR RESULT; (B) PRODUCT QUALITY, PURITY OR COMPOSITION WILL REMAIN UNCHANGED AFTER DELIVERY; (C) ANY INFORMATION, DATA OR SCIENTIFIC REFERENCE ON THE WEBSITE IS COMPLETE, ACCURATE OR CURRENT; OR (D) THE WEBSITE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE. PUBLISHED TEST REPORTS REFLECT RESULTS AT THE TIME OF ANALYSIS AND ARE NOT A WARRANTY OF FITNESS FOR ANY APPLICATION.

13. Manufacturing partners and laboratories

Products offered on the Website are produced by independent third-party manufacturers. Willow Peptides does not itself synthesise, formulate or package any product, and does not operate a manufacturing facility. Test reports are prepared by independent laboratories and are published as issued.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WILLOW PEPTIDES IS NOT LIABLE FOR ANY ACT, OMISSION, NEGLIGENCE, ERROR OR DEFECT ATTRIBUTABLE TO ANY MANUFACTURER, SUPPLIER OR TESTING LABORATORY, INCLUDING MANUFACTURING OR PACKAGING DEFECTS, CONTAMINATION, MISLABELLING, VARIANCE IN PURITY, IDENTITY OR COMPOSITION, OR DELAY IN SUPPLY. YOUR SOLE AND EXCLUSIVE REMEDIES FOR ANY PRODUCT ISSUE ARE THOSE SET OUT IN SECTION 7, AND ALL PRODUCTS REMAIN SUBJECT TO SECTIONS 12 AND 14.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WILLOW PEPTIDES AND ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE WEBSITE, PURCHASE OF PRODUCTS, OR ANY ACTION TAKEN ON INFORMATION PROVIDED ON THE WEBSITE, INCLUDING DAMAGES FOR PERSONAL INJURY, ILLNESS, DEATH, PROPERTY DAMAGE, LOSS OF PROFITS, LOSS OF DATA OR BUSINESS INTERRUPTION. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING UNDER OR RELATED TO THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO WILLOW PEPTIDES FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM. THIS LIMITATION APPLIES WHATEVER THE THEORY OF LIABILITY AND EVEN IF WILLOW PEPTIDES HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

15. Indemnification

You agree to indemnify, defend and hold harmless Willow Peptides, its owners, officers, employees, agents and affiliates from and against all claims, demands, actions, damages, losses, liabilities, judgments, settlements, fines, penalties, costs and expenses (including reasonable attorneys' fees) arising out of or related to any of the following.

Use of products

Your use, misuse or handling of any product, including any injury, illness, death or property damage resulting from the administration, injection, ingestion or application of a product to any human or animal.

Your statements

Any statement, claim, representation or advice you give to a third party about our products, including health claims, therapeutic benefits, dosing recommendations or instructions for human or animal use.

Your content

Any advertising, marketing, social media content, review or testimonial you create or distribute that references our products.

Breach

Any breach of these Terms, including the prohibited conduct in Section 9.

Law

Any breach of applicable law, regulation or third-party right in connection with your purchase, possession, use or distribution of products.

Regulatory action

Any regulatory action, investigation or enforcement proceeding brought against Willow Peptides as a result of your actions, statements or use of products.

16. Dispute resolution and arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Any dispute, claim or controversy arising out of or relating to these Terms, the Website or any product purchased from Willow Peptides shall be resolved exclusively through final and binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, before a single arbitrator.

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDING WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED OR REPRESENTATIVE ACTION, AND YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION OR CLASS-WIDE ARBITRATION AGAINST WILLOW PEPTIDES.

Either party may bring an individual action in small claims court for a dispute within that court's limits. Nothing in this section prevents Willow Peptides from seeking injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property or prevent irreparable harm. By agreeing to these Terms you acknowledge that you are waiving your right to a jury trial and to participate in a class action.

17. Changes, severability, waiver

We may modify these Terms at any time. Changes take effect when posted on the Website, and your continued use after that constitutes acceptance. Review these Terms periodically.

If any provision is found invalid or unenforceable, the remaining provisions continue in full force. Our failure to enforce any provision is not a waiver of it; a waiver is effective only in writing signed by us.

18. Entire agreement

These Terms, together with our Privacy Policy, Disclaimer and the shipping and returns pages, are the entire agreement between you and Willow Peptides regarding the Website and the purchase of products, and supersede all prior communications. No statement by any Willow Peptides representative, through support, email or any other channel, modifies these Terms unless set out in a written amendment signed by an authorised officer.

19. Information you provide

Placing an order or writing to support gives us information about you: a name, an email address, a shipping address, the order itself, and the Bitcoin invoice that paid for it. We use it to fulfil and support the order, to keep the store secure, and to meet our legal obligations. We do not sell it. The only marketing we send is the mailing list, which you join by asking and leave by replying to any message on it; placing an order does not add you to it. The Privacy Policy describes what is collected, who processes it and the rights you have over it.
